Understanding Texas Drug Trafficking Penalties

Drug trafficking is one of the most serious drug charges in Texas. Although the penalties depend on the amount of drugs involved and other circumstances, all drug trafficking offenses are considered felonies.

If convicted of a felony drug trafficking charge, you may face the following penalties:

  • Between 180 days to 2 years in a State Jail Facility (State Jail Facility)
  • Between 2 to 10 years in a Texas penitentiary (Third Degree Felony)
  • Between 2 to 20 years in a Texas penitentiary (Second Degree Felony)
  • Between 5-99 years in a Texas penitentiary (First Degree Felony)
  • Between 10 and 99 years or life in prison and fine up to $100,000 [Sale of between 200 and 400 grams] (Special Class Felony)
  • Between 15 and 99 years or life in prison and fine up to $250,000 [Sale of more than 400 grams] (Special Class Felony)

Federal Drug Trafficking Charges

Drug trafficking often involves importing and delivery drugs between two or more states or countries. For example, delivering or importing drugs from Mexico to Texas. However, if you are accused of drug trafficking in Texas and in another state or country, you could face both state and federal criminal charges.

For example, the following drugs and amounts are punishable by a federal prison sentence between five and 40 years, as well as a fine of up to $2,000,000 if only a person was involved or $5,000,000 if a group was involved:

Methamphetamine – Between five and 49 grams mixture

PCP – Between 10 and 99 grams of pure PPC or between 50 and 499 grams mixture

Fentanyl – Between 40 and 399 grams mixture

When it comes to trafficking marijuana, an offense involving 1,000 kilograms or more mixture, or $1,000 or more plants, carries a federal prison term between 10 years and life imprisonment and a fine of up to $4,000,000 if only a person was involved or $10,000 if a group was involved.
